Terms and Conditions of Use
Preamble
The Polaire.eu website (hereinafter the “Site”) is published by Joubert France, on behalf of the products and customers of its Polaire brand, a company registered with the Clermont-Ferrand Trade and Companies Register under number 421 243 841 (hereinafter “the Company”). These Terms of Use (hereinafter the “Terms”) set forth the conditions under which any Internet user (hereinafter the “User”) may access and use the Site. Access to the Site constitutes unconditional acceptance of these Terms of Use.
1. Purpose of the Website
The Site showcases the products and services of the Polaire brand and allows Users—depending on their profile (individual, business, or reseller)—to create a customer account, browse the catalog, place orders, and track their orders. The terms and conditions applicable to sales are set forth in the general terms and conditions of sale specific to each profile.
2. Access to the Site
The Site is accessible free of charge to any User with Internet access; the User is responsible for any connection fees. The Company takes reasonable measures to ensure continuous access to the Site, without being bound by an obligation of result: access may be suspended at any time, particularly for maintenance, updates, or any other technical reason, without the Company being held liable.
3. User Account
Features, whether public or restricted to certain user profiles, may evolve, be suspended temporarily or permanently, or be modified without users being entitled to any compensation or right to restoration.
Certain features (placing orders, order tracking, the “My Account” section, product registration, and vehicle management) require the creation of a customer account. The User agrees to provide accurate and up-to-date information when creating their account and to keep it current. Login credentials are strictly personal and confidential; the User is responsible for all use of their account. In the event of fraudulent use or loss of their login credentials, the User must notify the Company immediately. Reseller access is reserved for customers who resell Polaire brand products and services listed by the Company according to its internal criteria, which are subject to change. Access to the reseller portal does not automatically entitle the User to be listed in the reseller directory. The requirements for eligibility to access a reseller portal and to be listed as a reseller may be requested from the Company via the contact form or through the sales department

4. Orders
Orders placed on the Site are governed by the general terms and conditions of sale applicable to the buyer’s profile (consumer, business, or reseller), which can be accessed from the Site’s footer and during the checkout process. In the event of any conflict between these Terms of Use and the General Terms and Conditions of Sale, the latter shall prevail with respect to all matters concerning the sale.
5. Intellectual Property
The Site and all of its elements (text, photographs, illustrations, logos, trademarks, structure, graphic design, and databases) are protected by intellectual property law and remain the exclusive property of the Company or its partners. Any reproduction, representation, adaptation, or use, in whole or in part, without the Company’s prior written authorization is prohibited and constitutes infringement.

The Company processes personal data in accordance with the terms described in the privacy policy, which specifies, in particular, the purposes of the processing, retention periods, and the rights available to the User.
